Venue / Contestant Agreement & Liability Disclaimer

Please read this Agreement carefully before using the Local Stars platform located at localstars.live (the “Site” or “Service”). By creating an account, registering as a venue, or participating as a contestant/performer, you agree to be bound by the terms outlined below.
1. Service Availability & Limitation of Liability
1.1 As-Is Service
Local Stars is provided on an “as-is” and “as-available” basis. While we strive to maintain uninterrupted operation, we do not guarantee continuous, secure, or error-free access to the Service.
1.2 Force Majeure & Network Outages
Local Stars, its owners, operators, and affiliates shall not be held liable, financially or legally, for any failure, delay, or disruption of performance caused by events outside our reasonable control. This includes, but is not limited to:
- Internet service provider (ISP) outages or local network failures.
- Venue Wi-Fi failures, hardware malfunctions, or power outages.
- Third-party hosting, infrastructure, or telecom interruptions.
- Acts of God, government restrictions, or natural disasters.
1.3 Operational Disclaimer
Under no circumstances shall Local Stars be liable for lost venue bar sales, lost performer revenue, indirect damages, or consequential losses arising from system downtime during an event.
2. User-Generated Content & Moderation
2.1 Ownership of Content
Contestants and venues retain full ownership of all original photos, audio clips, video clips, logos, and profile information uploaded to localstars.live.
2.2 License to Use
By uploading content, you grant Local Stars a non-exclusive, royalty-free, worldwide license to display, host, and distribute such content solely for the operation and marketing of the Local Stars platform and related events.
2.3 No Content Liability
Local Stars acts solely as a venue management and talent portal and is not responsible for content uploaded, posted, or transmitted by contestants or venues. The uploading party is solely responsible for ensuring they possess the appropriate rights and copyright licenses for all uploaded material.
2.4 Acceptable Use & Immediate Removal
We reserve the absolute right—without prior notice or liability—to review, flag, or remove any content, contestant, or venue account that displays or promotes:
- Obscene, hate-speech, illegal, abusive, or sexually explicit content.
- Copyright-infringing material.
- Behavior that undermines the safety or integrity of an event.
3. Refunds, Payments & Administration Fees
3.1 No Refunds for Change of Mind
All purchases, subscription fees, entry fees, and booking charges made on localstars.live are final. Refunds will not be granted due to a change of mind, scheduling conflicts, or voluntary withdrawal by a contestant or venue.
3.2 System Failure Refund Policy
In the rare event that the Local Stars platform experiences a complete system failure attributable directly to our primary software infrastructure during a scheduled event, refund requests may be submitted in writing within 48 hours of the event end time.Approved refunds will be issued minus an administrative fee (covering third-party credit card processing fees and handling costs).Refunds are strictly limited to fees paid directly to Local Stars for that specific event session and will not exceed the net amount received by Local Stars.
4. Privacy, Data Protection & Account Deletion
4.1 Data Collection
We collect only the personal information necessary to operate the platform, process events, and maintain platform security (e.g., name, contact details, venue location, and profile data).
4.2 Data Removal Requests (“Right to be Forgotten”)
In compliance with standard privacy legislation, you may request complete deletion of your personal data held on our servers at any time by contacting our support team or initiating an account deletion request within localstars.live. Upon verification, your personal data will be permanently removed, subject to any legal or financial record-keeping obligations.
5. Security & Account Integrity
5.1 Infrastructure Security
localstars.live is hosted on modern, cloud-native infrastructure utilizing enterprise-grade encryption standards (SSL/TLS in transit, encrypted databases at rest) to safeguard user credentials and transactional data.
5.2 Two-Factor Authentication (2FA)
To protect venue accounts, management portals, and contestant profiles from unauthorized access, Local Stars supports and strongly encourages Multi-Factor / Two-Factor Authentication (2FA). Users are responsible for keeping their login credentials secure.
5.3 Account Security Responsibility
Local Stars is not liable for unauthorized access or losses resulting from compromised user passwords, shared credentials, or un-secured user devices.
6. Profit Protection & Additional Financial Safeguards
6.1 Chargebacks & Payment Disputes
Unjustified credit card chargebacks initiated by a venue or contestant will result in immediate suspension of the associated account. Local Stars reserves the right to recover chargeback fees, administrative costs, and legal fees associated with disputing fraudulent or invalid chargebacks.
6.2 Indirect & Consequential Damages Cap
To the maximum extent permitted by applicable law, Local Stars’ aggregate liability for any claim arising out of or relating to the platform—whether in contract, tort, or otherwise—is strictly capped at the total amount paid by you to Local Stars during the thirty (30) days preceding the event giving rise to the claim.
6.3 Indemnification
You agree to defend, indemnify, and hold harmless Local Stars, its owners, directors, and employees from any claims, damages, liabilities, or legal expenses arising from your breach of this Agreement, your uploaded content, or your conduct during an event.
6.4 Severability
If any provision of this Agreement is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in full force and effect.
Acceptance of Terms
By creating an account or logging into localstars.live, you acknowledge that you have read, understood, and agreed to these Terms of Service.
